Terms of use
These terms of use govern the use of the online platform aftersnap (“aftersnap” or “the service”). By registering or using it, you accept these terms.
1. Provider & scope
The provider of the service is Danyel André Maus, Cami des Jardi d'en Ferrer 72, ES-07141 Marratxí, Spain, email [email protected] (“the provider”). Further details are in the legal notice. These terms apply to all users of the service, in particular to photographers as customers and to invited vendors.
2. What the service does
aftersnap is a software-as-a-service platform that photographers use to create and manage private and public online galleries and to make them available to their clients. Depending on the plan chosen, the features include gallery delivery, a slideshow with music, downloads, selfie and face search, a vendor portal, connecting your own domain, and interfaces such as a Lightroom plugin. What a plan covers in detail follows from the current description on the website and from the plan booked. The provider keeps developing the service and may change, add or discontinue individual features.
3. Registration & account
Using the service as a photographer requires an account. The information given at registration must be truthful and current. Login credentials are confidential and must be protected against access by third parties. The account holder is responsible for everything done through the account.
4. Plans, prices & payment
The service comes in several plans; their scope and prices follow from the current price overview. Unless stated otherwise, prices include statutory value-added tax. If the statutory value-added tax rate changes, the gross price changes accordingly as of the date the change takes effect; the net price remains the same. The provider may adjust prices and plans with effect for the future; changes are announced in good time.
5. User obligations & permitted use
Users undertake not to use the service unlawfully or abusively. In particular, they may not upload or distribute content that violates applicable law, the rights of third parties (copyright, trademark or personality rights, for example) or public decency.
Plans without fixed storage or volume limits (“Unlimited”) are intended for the usual scope of a photography business. Use that substantially exceeds this scope (for example as a pure data archive without any gallery context, to provide storage to third parties, or through automated bulk uploads) is not permitted. If the provider identifies such overuse, it will point this out and allow time to remedy it; if this does not happen, the provider may suspend the account or terminate the agreement for cause.
The users who upload photos and other content published through aftersnap are solely responsible for them. They warrant that they hold the rights required for the content and that, where people are shown, they have obtained the necessary consents. Under data protection law, photographers remain the controllers for the personal data of the people shown that they process.
6. Rights in content & indemnification
All rights in uploaded content stay with the users. They grant the provider only the non-exclusive right, unrestricted as to territory, that is needed to provide the service: to store the content, process it technically (computing previews and formats, for example) and make it available to the recipients the users designate.
Users indemnify the provider against all third-party claims brought because of unlawful use of the service for which those users are responsible, or because of a breach of these terms.
7. Connecting third-party services (including the Google Business Profile)
The service offers optional interfaces to third-party providers. If a photographer voluntarily connects their Google Business Profile, aftersnap accesses the relevant data only to the extent required and only for the purpose of the requested feature, in particular location and review data from their own listing, in order to provide the review link. The permission granted can be withdrawn at any time in the account (disconnect) and in the security settings of the Google account. The terms and policies of the third-party provider apply in addition. The privacy policy has more on the data processing.
8. Availability & maintenance
The provider works toward high availability of the service but does not owe uninterrupted access. Maintenance, further development and disruptions caused from outside (at hosting or third-party providers, for example) can lead to temporary restrictions.
9. Liability
The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of ordinary negligence, the provider is liable only for the breach of a material contractual duty (cardinal duty), and then limited to the damage typically foreseeable for this kind of contract. Liability is otherwise excluded. The provider accepts no liability for user content or for the lawfulness of the processing that users initiate.
10. Term, termination & deletion
Unless agreed otherwise, either side may end the contract at any time with effect from the end of the current billing period. The right to terminate for good cause remains unaffected. Once the contract ends, the content stored in the account may be deleted after a reasonable period; users are themselves responsible for backing up their data in time.
11. Data protection
The privacy policy explains how personal data is processed.
12. Changes to these terms
The provider may change these terms of use with effect for the future where there is good reason to do so (a change in the law or added features, for example) and where the change does not put users at an unreasonable disadvantage. Material changes are announced in a suitable manner.
13. Final provisions
Spanish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Users acting as consumers keep the protection of the mandatory provisions of the country in which they are habitually resident. Should individual provisions be invalid, the remaining provisions stay in force.
